Welcome to Flotsam. These Terms of Service ("Terms") govern your access to and use of Flotsam (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Flotsam does

Flotsam lets you capture ideas, tasks, notes, and pictures by texting an AI-powered phone number. The Service automatically categorizes and annotates your messages and presents them to you in a web interface.

Accounts

• Your account is tied to the phone number you use to text Flotsam.
• You are responsible for keeping access to your phone and the device you use to sign in to the web interface secure. Do not share your login links.
• You must be at least 13 years old to use Flotsam. If you are under the age of majority in your jurisdiction, you must have permission from a parent or guardian.

Acceptable use

You agree not to use the Service to:

• Violate any law or the rights of others.
• Send content that is unlawful, harassing, defamatory, or infringing.
• Upload malware, attempt to breach the Service's security, or interfere with other users.
• Attempt to reverse engineer, scrape, or resell the Service without permission.
• Use the Service to generate spam or unsolicited bulk messages.

We may suspend or terminate accounts that violate these rules.

Your content

You retain ownership of the messages, notes, and images you send to Flotsam ("Your Content"). By using the Service, you grant us a limited license to store, process, display, and transmit Your Content solely to operate and provide the Service to you — for example, to run it through our AI categorizer and show it back to you in the web interface.

You are responsible for Your Content and for making sure you have the right to send it to Flotsam.

AI-generated output

Flotsam uses large language models to categorize and annotate your messages. AI output can be inaccurate, incomplete, or inconsistent. You should not rely on Flotsam for decisions where mistakes could cause harm, and you should verify anything important.

Messaging rates and consent

When you text a Flotsam number, your mobile carrier's standard message and data rates may apply. By sending a message to Flotsam, you consent to receive SMS replies from us related to the Service, including login codes and system notifications. You can stop messaging Flotsam at any time to end the back-and-forth.

You can opt out of text messages at any time by replying STOP. To resubscribe, reply START.

Paid plans and billing

Some features may require a paid subscription. If you sign up for a paid plan, you authorize us (and our payment processor, Stripe) to charge the payment method you provide on a recurring basis until you cancel. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice.

Service availability

We work to keep the Service running, but we do not guarantee uninterrupted, error-free, or perfectly secure operation. We may update, modify, or discontinue features at any time.

Termination

You can stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. On termination, your right to use the Service ends, though certain provisions of these Terms will survive.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that AI-generated output will be accurate.

Limitation of liability

To the fullest extent permitted by law, Flotsam and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $50.

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will make a reasonable effort to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
